1. Overview

This website is operated by InCharge Solar ("InCharge Solar," "we," "us," or "our"). By visiting inchargesolar.com, creating an account, placing an order, or booking a service (together, the "Services"), you agree to these Terms of Service ("Terms") and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Services.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and services to you.

2. Eligibility

You must be at least the age of majority in your state of residence to use the Services or place an order. You agree to provide accurate, current and complete information when you check out or create an account, and you are responsible for keeping your account credentials secure.

3. Products, Pricing and Availability

We try to describe our products, specifications and images as accurately as possible, but we do not guarantee that every description, color, image or other content is error-free, complete or current. Products are sold for use in the United States with US outlets and electrical systems only.

Prices, availability and product offerings may change at any time without notice. Some products may be listed as "Call for quote" or "Coming soon" and are not available for immediate purchase. We may limit quantities, refuse or cancel any order, including after an order confirmation has been sent, for example if a product is unavailable, a price or description was listed in error, or we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

4. Orders and Payment

By placing an order you confirm that you are authorized to use the payment method provided. Payments are processed through Shopify's checkout and its payment partners; we do not store your full card details. All prices are in US dollars. Applicable sales taxes and shipping charges are shown at checkout.

5. Shipping, Returns and Refunds

Shipping times shown on the site are estimates and are not guaranteed. Risk of loss passes to you when your order is delivered to the carrier. Returns, exchanges and refunds are governed by our Refund Policy.

6. Installation and Electrician Services

Some products, such as the generator inlet and interlock kit, require installation by a licensed electrician. When you purchase an Electrician Visit or installation service, the work is performed by a licensed electrician, and scheduling depends on availability in your area. The electrician may decline or adjust the work if, in their professional judgment, your electrical system is unsafe or does not meet code, or if a permit or utility approval is required. Any additional work beyond the booked scope will be quoted to you before it is performed.

7. Safe and Lawful Use

You are responsible for using our products according to the manufacturer's instructions and all applicable electrical codes, permit requirements, homeowner association rules and utility interconnection rules where you live. Rules for plug-in and balcony solar differ by state, city and utility, and some jurisdictions or utilities may restrict or prohibit connecting equipment to your home's wiring without approval. Information on our website and blog is general guidance only and is not electrical, legal or tax advice. Consult a licensed electrician and your local utility before installing any equipment.

8. Warranties

Products are covered by the manufacturer's warranty, where one is provided. Please refer to the manufacturer's documentation for warranty terms. Except for those manufacturer warranties and to the fullest extent permitted by law, the Services and products are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any specific amount of energy production or savings, which depend on factors such as sun exposure, weather, placement, equipment and your utility rates.

9. Limitation of Liability

To the fullest extent permitted by law, InCharge Solar and its owners, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or savings, arising out of your use of the Services or any product. Our total liability for any claim relating to the Services or a product will not exceed the amount you paid us for that product or service. Some states do not allow certain limitations of liability, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless InCharge Solar and its owners, employees, contractors and suppliers from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or third-party right, or your installation or use of products in a manner that is not consistent with the manufacturer's instructions or applicable codes.

11. Intellectual Property

All content on this website, including text, graphics, logos, images and page designs, belongs to InCharge Solar or its licensors and is protected by intellectual property laws. You may not copy, reproduce or use it for commercial purposes without our written permission. Manufacturer names and trademarks belong to their respective owners.

12. User Content and Feedback

If you send us reviews, comments, suggestions or other content, you grant us a non-exclusive, royalty-free right to use, reproduce and display it in connection with the Services. You agree not to submit anything that is unlawful, misleading, infringing or harmful.
